Is there a meaningful choice about cookies and tracking before data is collected?

OneTrust is loaded and shown to Quebec alone. No banner appears on a first load, and clearing every cookie and reloading does not produce one. lululemon’s public OneTrust configuration has two rules, a Quebec one that displays the banner and a global one covering the rest of Canada that does not. A “Your Privacy Choices” link in the footer opens a working privacy centre, so the mechanism is real, reachable and clearly labelled; outside Quebec it is simply never offered. Six tracking identifiers, including Meta, TikTok, Reddit and Snapchat, are set on arrival. Where the policy does discuss opting out of interest-based ads, it sends you to the industry page at aboutads.info rather than to its own controls.

The request portal is genuinely good and sits two clicks from the front door, ahead of most banks. The consent banner exists, works, and is never shown, so six advertising identifiers are set before a shopper has any idea a choice was available. Showing the panel it already owns would move this score two points.
