18 out of 20 Trust-aware

Everything works, and there are two of it: the footer links two different privacy policies, seventeen months apart.

Transparency, Consent, Clarity, Control, Empathy · clockwise from the top
01
Transparency 4 / 4

How many clicks to find the privacy policy from the homepage?

One click, from the footer, twice over. The footer carries both a “Privacy Policy” link and a “Privacy” link. They go to different documents. Either way the policy is one click away, which is what this dimension asks.

02
Consent 4 / 4

Is there a meaningful choice about cookies and tracking before data is collected?

Reject and Accept All at the same size, in the same colour. The banner renders Reject and Accept All at 342 by 52 pixels each, on the same background, with a clearly labelled Privacy Settings button above them that opens a preference centre. Nothing about the design pushes you toward agreeing. The consent platform is Clarip, not the OneTrust that most of this sector runs.

03
Clarity 2 / 4

How hard is the policy to read, how much of it is there, and can you get it in one piece?

Grade 13.0 across 5,250 words, in two versions. Difficulty 1, length 2, access 2. The document at /pages/privacy-policy is dated 1 July 2025; the one at /policies/privacy-policy is dated 19 January 2024 and runs 4,832 words. Both are linked from the same footer, and a reader has no way to tell which governs. That is what the access mark is for. Measure it yourself.

04
Control 4 / 4

How many clicks to reach data settings, and can you delete your account yourself?

Do Not Sell or Share, one click from the footer. The link opens a Kendo-branded opt-out panel that reads any Global Privacy Control signal your browser sends and reports what it found. Deletion itself goes by email rather than through the panel, to fentyprivacy@kendobrands.com, with a named data protection officer at dpo@kendobrands.com beside it.

05
Empathy 4 / 4

Find the support page. How many clicks, and is there a way to speak to a human?

Contact Us and a help centre from the footer, plus chat on the page. A message form, a Gorgias help centre and a chat widget, all within two clicks.

Overall finding

18 out of 20 Trust-aware

Fenty Beauty is run by Kendo Holdings, the LVMH beauty incubator, and it shows in the tooling: a consent banner with genuinely equal buttons, an opt-out that reads Global Privacy Control, a named data protection officer. It scores 18. The flaw is administrative rather than philosophical. Its own footer links two different privacy policies seventeen months apart, and the older one is the one labelled “Privacy Policy”. Along the way the published policy also carries a link into Kendo’s own Shopify admin, left behind when the text was pasted in. Nobody has read this document end to end in a while.
