Is there a meaningful choice about cookies and tracking before data is collected?

The banner exists, and Canada is switched out of it. Nothing shows on a first load, and clearing every cookie and reloading does not produce one either. Aritzia’s own OneTrust configuration, which is public, explains why: it carries separate rules named “EU”, “USA (Florida)”, “USA (Opt-Out States)” and “CAN (QC)”, and every one of those displays the banner. The rule named “CAN (Excl. QC)”, which lists nine provinces and three territories by name, does not. Aritzia asks Europeans, Floridians and Quebecers, and shows the rest of Canada nothing. A “Manage Cookies” link does sit in the footer and the preference centre behind it works, so the machinery is reachable by anyone who thinks to look. In Aritzia’s favour, the footprint is unusually light for a retailer of this size: three tracking identifiers on arrival where most of this set have eight or more.

The preference centre is bought, configured and reachable from the footer, and because nothing announces it, the practical experience is identical to a site with no consent mechanism at all. It is the same finding as Indigo, at a company whose whole proposition is that presentation matters.
